Welcome to CheerBanq, a financial planning app for competitive cheerleading families, operated by Nocturne AI LLC. By downloading, installing, or using CheerBanq, you agree to be bound by these Terms. For Nocturne AI LLC's platform-wide Terms of Service, visit nocturneai.net/terms. If you do not agree, do not use the app.

CheerBanq is designed for parents and legal guardians managing cheerleading finances. To create an account, you must: • Be at least 18 years old • Be the parent or legal guardian of the athlete or athletes in the app • Provide accurate account information • Have legal authority to agree to these Terms for your family A single account is intended for one family household. Do not share credentials outside your household.

We grant you a limited, non-exclusive, non-transferable, revocable license to use CheerBanq on your personal device for household financial planning. You agree not to: • Reverse engineer or decompile the app • Remove copyright or proprietary notices • Use the app for illegal purposes • Use the app commercially on behalf of other families without a written agreement with Nocturne AI LLC

You own your data. All financial entries, athlete profiles, and season data belong to you. We do not claim ownership. Accuracy: You are responsible for the accuracy of the information you enter. CheerBanq provides planning tools, not licensed financial advice. All projections are estimates based on your data. Local storage: All data is stored locally on your device in the current version. You are responsible for your device security. We are not liable for data loss due to device failure, theft, or app uninstallation. Future cloud sync: When optional cloud sync launches, you must explicitly opt in before any data leaves your device.

Free access: The current version is available at no charge during the development and beta period. Future plans: If paid tiers are introduced, you will receive at least 30 days notice before any feature moves behind a paywall. Refund policy: Refund requests must be submitted within 30 days of the charge to support@nocturneai.net and are evaluated case by case.

By granting notification permission, you consent to locally scheduled reminders tied to your season data. You may withdraw permission anytime in your device settings or in the app's notification settings. CheerBanq does not send marketing push notifications.

Exports are generated entirely on your device. When you share content through your device's share sheet, that sharing is governed by your chosen app and platform, not by Nocturne AI LLC. We are not responsible for how you share your exported data.

Nocturne AI LLC owns the app, its design, code, algorithms, and branding, including the CheerBanq interface, Smart Assist logic, confidence scoring system, and Scenario Planner engine. You retain all rights to the data you enter. Nothing in these Terms transfers ownership of your financial data to us.

Not financial advice: CheerBanq is a personal budgeting tool. It does not constitute financial advice, tax guidance, or professional financial planning services. Consult a qualified professional for significant financial decisions. No guarantees: The app is provided as is. We do not guarantee uninterrupted operation, accuracy of projections, or compatibility with all devices. Notifications: Local push notifications depend on your device OS, permissions, and power settings. We cannot guarantee delivery of all scheduled notifications.

To the maximum extent permitted by law, Nocturne AI LLC is not liable for: • Indirect or consequential damages • Financial decisions made based on app projections • Data loss due to device failure or app uninstallation • Service interruptions Maximum liability: Our total liability for any claim shall not exceed the amount you paid us in the prior 12 months, or $100, whichever is greater.

You agree to indemnify and hold harmless Nocturne AI LLC from claims, damages, or expenses arising from your use or misuse of the app, your violation of these Terms, or financial decisions you make based on app outputs.

By you: Stop using and uninstall the app at any time. Uninstalling removes all local data. When cloud sync is available, request account deletion at data-requests@nocturneai.net. By us: We may suspend or terminate your access for Terms violations or fraud, with reasonable notice except where immediate action is required.

We may update these Terms. Material changes will be communicated via in-app notification and email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

Governing law: State of Texas. Informal resolution: Contact support@nocturneai.net before filing any legal claim. Venue: Courts of Comal County, Texas. You consent to personal jurisdiction there. No class actions: Disputes must be resolved on an individual basis only.

These Terms, together with the CheerBanq Privacy Policy, constitute the entire agreement between you and Nocturne AI LLC. If any provision is found unenforceable, the remainder stays in effect.
